RM of McKillop 220 - Zoning Bylaw Amendments - Bylaw No. 472-2026

Public Notice

Public Notice

October 22 2026

Public Notice is hereby given that the Council of the Rural Municipality (RM) of McKillop No. 220 intends to consider adoption of a Bylaw (No. 472-2026) under The Planning and Development Act, 2007; a proposed amendment to Bylaw No. 376/2019, known as the Zoning Bylaw (ZB).

INTENT:  The proposed amendment would effect several changes to the ZB related to use and placement of recreational vehicles, park model trailer and recreational vehicle variants, and the regulation thereof. Said items shall be referred to as “recreational units” in the balance of this notice. Regulations related to timing of placement of residential accessory buildings would also be amended. A number of related housekeeping amendments for clarity would also be included.

Further detail and specifics are as follows:

  • Recreational units would be introduced as an allowable permitted accessory use, where accessory to a principal agricultural use of a site within the AR1 and AR2 Districts, would be exempt from permitting, but subject to the placement regulations of any agricultural principal use.
  • Clarity would be provided to the 4.2 General Development Standards section indicating that the general provisions of this section apply to all development unless more specific regulation is prescribed therein or within a zoning district.
  • All of 4.3 Principal Use Established pertaining to the timing of establishment of accessory uses would be replaced clarifying timing and placement of accessory buildings and temporary recreational units; accessory use regulations in 4.9.6 would be amended to similar effect. The existing allowance for establishment of a small accessory building under 13.94 m2 (150 ft2) prior to a principal building would remain but would be more clearly regulated. Existing provisions to allow the establishment of an accessory garage on a site 5 years prior to the establishment of a principal building would be removed. The current scheme allowing temporary placement of recreational vehicles as a principal use would be replaced with a new and more comprehensive scheme.
  • Content would be added to 4.9 pertaining to general provisions for accessory buildings, uses, and structures for consistency and clarity in regulation thereof.
  • A new general regulation section 4.50 would be added to address and regulate the temporary permitting of a recreational unit as the principal use on a site (up to ten years). Certain exclusions would apply to the LS3 District.
  • Temporary placement of a recreational unit use would be added as a principal permitted use to the CR1, CR2, H, LS1, and LS2 Districts, and regulated accordingly.
  • LS3 District would be modified to harmonize regulation to some degree with the that proposed for the above-mentioned Districts, and recreational units would be introduced as an allowable permanent permitted use.
  • Other related modifications would be enacted to accomplish that which is described above.

AFFECTED LAND:  All lands in the RM would be affected as a number of amendment items would apply to the general regulation provisions. With respect to recreational units as a use however, the proposed amendment would not affect lands zoned RR, C1, or C2 Districts, but would affect all other Districts.

REASON:  The RM is pursuing the proposed new regulatory scheme for recreational units largely in response to demand for said use in lake/cottage contexts. It is acknowledged by Council that this form of development can be contentious and does raise legitimate concerns with existing property owners who have established permanent forms of development. As such, Council is considering a revised temporary permitting scheme as proposed in the subject amendment, designed to have a time-limited impact and to encourage permanent forms of development. Council has recently adopted a separate municipal bylaw to allow for the licensing and collection of fees in lieu of municipal taxes not typically assessed upon non-permanent forms of development, which supports and informed the approach taken towards the proposed subject amendment. Separate, but somewhat related, Council is wanting to remove a current provision in its ZB that allows for the establishment of an accessory garage up to five years prior to a principal building, as it has found a granting of this flexibility to be undesirable, problematic, and challenging to enforce removal when owners do not establish their principal use (typically a dwelling) within the prescribed timeframe.

PUBLIC INSPECTION:  Any person may inspect the proposed bylaw at the RM of McKillop No. 220 office during regular office hours, excluding statutory holidays.  Digital copy of the proposed bylaw is available here for public viewing: https://rmofmckillop220.com/p/local-notices . The RM will be streaming the public hearing through ZOOM, and those persons wanting to observe or make representation through this digital medium are requested to contact the RM office for a hyperlink to join the hearing.
